These Terms of Service (the "Terms") apply when you visit kaelorworks.co.uk, use its features or place an order with Kaelor Works. In these Terms, "we", "us" and "our" mean Kaelor Works, and "you" means the person using the website or purchasing from us.

Please read these Terms together with our Privacy Policy, Refund Policy and Shipping Policy. Product-specific information shown on a product page also forms part of the contract for that product. Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded or restricted.

1. Using this website

You must use this website lawfully and must have legal capacity to enter into a contract. If you are under 18, a parent or guardian must place any order on your behalf.

You must provide accurate, current and complete information when creating an account, contacting us or placing an order. You are responsible for keeping your account credentials confidential and for activity carried out through your account, except where that activity results from our failure to use reasonable care.

We may suspend or restrict access to the website where reasonably necessary to protect the website, customers or third parties, or where we reasonably believe there has been unlawful, fraudulent or abusive use. This will not affect an accepted order or any rights and remedies that have already arisen.

2. Product information and availability

We take reasonable care to ensure that product descriptions, specifications, prices, images and availability information are accurate. Images are illustrative, and colours or displayed phosphor output may vary because of screen settings, lighting and normal characteristics of the product. Where a product contains an image-intensifier tube or another optical or electronic component, measured performance and cosmetic characteristics may vary within any specification expressly stated on the relevant product page.

We may correct an error or update product information before accepting an order. If we discover a material error after accepting an order, we will contact you and offer an appropriate solution, which may include confirming the corrected information, providing an alternative or cancelling the affected item for a full refund.

Products and options remain subject to availability. Built-to-order, special-order or customised products may have preparation times and conditions stated on their product pages. A preparation time is the period before dispatch and is not a guaranteed delivery date.

3. Orders and contract formation

Placing an order is an offer to buy the products in your basket. An automated order acknowledgement confirms that we received the order but does not by itself mean that we have accepted it. A contract is formed when we send an email expressly accepting the order or confirming dispatch, whichever occurs first.

We may decline an order before acceptance for a reasonable reason, including lack of availability, an obvious pricing or description error, failed payment authorisation, suspected fraud, a delivery restriction or a legal or regulatory restriction. If payment has already been taken, we will refund the amount paid for the declined order.

Please review your order details before submitting them. Requests to change or cancel an order are handled in accordance with our Refund Policy and your statutory rights.

4. Prices and payment

The price and currency shown at checkout are the price and currency that apply to your order, subject to correction of an obvious error before acceptance. Any delivery charge, tax or other amount collected by us will be shown before you place the order.

Standard delivery to United Kingdom addresses is free unless a product page or checkout clearly states otherwise. International taxes, customs charges and import fees are handled as described in our Shipping Policy or in a specific product-page offer. Where a product page expressly states that Kaelor Works will handle customs clearance or destination charges, that product-specific statement applies.

You confirm that you are authorised to use the payment method supplied and that the billing information is accurate. Payment may be authorised or collected before we accept the order. If we do not accept the order, any amount collected will be refunded.

5. Delivery and passing of risk

Delivery dates and transit times are estimates unless we expressly agree a fixed date with you. We will take reasonable steps to dispatch and deliver within the stated timeframe and will contact you if we become aware of a significant delay. Your statutory rights relating to late delivery are not affected.

Goods remain at Kaelor Works' risk until they come into the physical possession of you or a person you have identified to receive them. If you independently commission a carrier that we did not offer or name, risk passes when the goods are delivered to that carrier, as provided by applicable law.

If an order is lost or damaged in transit before risk has passed to you, please contact us promptly. We will deal with the carrier and provide the remedy required by law. We may ask for reasonable evidence of damage or non-delivery, but this does not reduce your statutory rights.

6. Cancellations, returns, faulty goods and warranty

Our voluntary returns arrangements and the procedure for exercising cancellation rights are set out in our Refund Policy.

If you are a consumer, the Consumer Rights Act 2015 requires goods to be of satisfactory quality, fit for a particular purpose made known to us and as described. It provides remedies where those requirements are not met. Nothing in these Terms, our Refund Policy, a product page or a commercial warranty limits those statutory rights.

Any one-year warranty or other commercial warranty offered by Kaelor Works is an additional benefit. It does not replace or restrict your rights under the Consumer Rights Act 2015 or any other mandatory consumer law that applies to you.

7. Export controls, sanctions and destination restrictions

Some night vision, thermal imaging, fusion, optical or related products may be subject to United Kingdom export controls, trade controls, sanctions, licence requirements, destination restrictions, end-use or end-user controls, carrier restrictions or laws in the destination country. The availability of a product on the website does not confirm that it may lawfully be supplied to every destination.

We may screen an order and request information reasonably required for compliance, including the identity of the purchaser or recipient, destination, intended end use and end user. We may pause an order while a licence, authorisation or compliance check is pending.

We may refuse or cancel an order where we cannot lawfully supply, export, transfer or deliver the product; a required licence or authorisation is unavailable; a sanctions, destination, end-use or carrier restriction applies; or we reasonably believe that fulfilment would breach applicable law. Where we cancel for one of these reasons, we will give you a full refund of all sums paid to us for the affected order.

You must not export, re-export, transfer, resell, supply or use a product in breach of applicable export-control, sanctions, import, possession or usage laws. You are responsible for checking the laws that apply to possession, import and use in the destination after delivery. Nothing in these Terms requires either party to perform an act that would be unlawful.

8. Safe and lawful use of products

You must use products lawfully, responsibly and in accordance with the manufacturer's or supplier's instructions, warnings and maintenance requirements. You must not use a product in a way that infringes another person's rights, endangers others or breaches applicable law.

To the extent permitted by law, we are not responsible for loss caused by unlawful use, misuse, failure to follow supplied instructions, unauthorised modification or damage occurring after risk has passed to you, except to the extent that the loss was caused by our breach of contract, negligence or failure to meet a statutory duty.

9. Intellectual property

The website and its text, photographs, graphics, videos, logos, layout and other content are owned by or licensed to Kaelor Works or the relevant rights holder and are protected by United Kingdom and other applicable intellectual-property laws.

You may view and use the website for personal, lawful shopping and information purposes. You must not copy, republish, commercially exploit, remove rights notices from or create derivative works from protected content without permission, except where applicable law allows it.

10. Prohibited website use

You must not use the website to commit fraud or another unlawful act; introduce malware or harmful code; interfere with the website or another user's access; attempt unauthorised access to systems, accounts or data; misrepresent your identity; or infringe the rights of Kaelor Works or any third party.

Reasonable security measures, rate limits and access controls may be used to protect the website. Nothing in this section restricts lawful use of publicly available information or any right that cannot lawfully be restricted.

11. Shopify and third-party services

Our online store is hosted by Shopify, which provides the ecommerce platform used to present products and process parts of your transaction. Your contract for products purchased from this store is with Kaelor Works, not Shopify.

The website may contain links to, or integrations with, third-party services. We are not responsible for a third party's independent content, availability or conduct. Please review the third party's terms and privacy information before using its service. This does not exclude responsibility that the law places on us for services we select or use to fulfil our contract with you.

12. Privacy

We process personal information as described in our Privacy Policy. Shopify and other service providers may process information on our behalf to operate the store, take payment, prevent fraud, communicate with you and fulfil orders.

13. Our responsibility for loss or damage

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was formed, both you and we knew that it might happen.

We do not exclude or limit liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory rights under the Consumer Rights Act 2015;
  • defective products where liability cannot lawfully be excluded; or
  • any other liability that cannot lawfully be excluded or limited.

When you purchase as a consumer, we do not accept responsibility for business losses, including loss of profit, revenue, business, contracts, anticipated savings, data or business opportunity. If we expressly agree to supply you as a business customer, any separate written trade terms will apply, subject always to liability that cannot lawfully be excluded.

Nothing in this section limits a remedy expressly provided by these Terms, our policies or applicable law.

14. Events outside our reasonable control

We are not responsible for delay or failure caused by an event outside our reasonable control, provided that we take reasonable steps to reduce the effect of the event and resume performance when reasonably possible. We will contact you if such an event materially affects your order. Your rights to cancel for significant delay or non-delivery are not affected.

15. Transfer of rights

We may transfer our rights or obligations under a contract to another organisation only where this does not reduce your rights. We will notify you if a transfer materially affects you. You may transfer your rights where the law permits or with our written agreement.

16. Severability and waiver

If a court or other competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply. If we do not immediately enforce a right, that does not waive the right.

17. Governing law and courts

These Terms and any contract between you and Kaelor Works are governed by the laws of England and Wales. If you are a consumer who normally lives in another part of the United Kingdom or another country, this choice of law does not deprive you of mandatory consumer protections provided by the law of the place where you normally live.

The courts of England and Wales will have jurisdiction. If you are a consumer living in Scotland, you may also bring proceedings in the Scottish courts. If you are a consumer living in Northern Ireland, you may also bring proceedings in the Northern Irish courts. Consumers living outside the United Kingdom retain any mandatory rights concerning jurisdiction that apply in their place of residence.

Please contact us first if you have a concern so that we can try to resolve it promptly. This does not restrict your right to seek independent advice, use any available dispute-resolution process or bring court proceedings.

18. Changes to these Terms

We may update these Terms from time to time by publishing a revised version on this page. Changes apply prospectively. The version in force when we accept your order will apply to that order unless a change is required by law or you and we expressly agree otherwise.
